Power of attorney intake

This is the intake we draft a power of attorney from: who you are appointing to manage your property and finances, when the document should take effect, and the limits you want on it. Your answers are kept on this device until you send them, so you can stop and come back.

4 sections. Your answers are kept on this device until you send them or clear them. Nothing leaves it until you press send.

About you

Full legal names, exactly as they appear on government identification. No initials.

Relationship status

Only if it applies to you.

Does your spouse want a power of attorney as well?

Each is a separate document. Most couples do them together, usually naming each other.

Only if it applies to you.

Your attorney

The person you are appointing. "Attorney" here means your representative for property and money, not a lawyer. Choose someone you trust with a bank account, who is likely to be available when the document is needed.

Full legal names, exactly as they appear on government identification. No initials.

Spouse, daughter, brother, friend, and so on.

Do you want an alternate, if your attorney cannot act?

Only if it applies to you.

How should they act?

How it should work

Have you given anyone a power of attorney before?

Only if it applies to you.

Should the new document cancel the old one?
Should the power of attorney keep working if you lose the capacity to manage your own affairs?

This is what makes it enduring, and it is the reason most people make one. One that is not enduring ends at exactly the moment it is usually needed.

When should your attorney be able to act?

Only if it applies to you.

For example, a sale or purchase you will be away for. Give the property address if it is for a specific transaction.

Do you own real property?

A power of attorney used for land has to be registered at the Land Title Office, and we prepare it with that in mind.

Only if it applies to you.

The Act limits what an attorney can do for their own benefit unless the document says otherwise. Each of the following is off unless you turn it on.

May your attorney make gifts to charity on your behalf?

Within limits the Act sets, and only where you would have.

May your attorney use your property for their own benefit, or for anyone other than you?

Sometimes right, for a spouse who is also the attorney. Usually not.

May your attorney hire professionals, such as an accountant or an investment manager, to help?
May your attorney appoint a replacement if they can no longer act?
Should your attorney be paid?

Reaching you

How you would rather be contacted, who to thank for sending you, and anything the questions above did not cover.

How would you rather be contacted?
How did you hear about the firm?

Only if it applies to you.

Optional, and the only reason we ask is so we can.

Anything the questions above did not cover: a business the attorney would have to run, a property outside the province, a family circumstance we should know about before the meeting.

Before you send it
